"...The report confirms the Commission's proposal to include all products with digital elements. It underlines however the importance to ensure that developers of **open source** software are **excluded** from the scope if they are not receiving any financial returns for their projects."

@amarok A requirement like "if they are not receiving any financial returns" does not make sense here, who knows if someone got paid to do some work. Probably the people who wrote that do not understand the concept of free software.

As the Debian statement says, free software is a gift to society. It is a terrible idea to put burdens on those who make free software.

@debian

@amarok That's the point. Many Debian Developers are getting paid (not by Debian) to work on Debian; that's "receiving financial returns for their projects".

@OdyX
The sentence in that report is so obscure and unclear, I wonder how anyone should take any legal actions against individuals involved in opensource projects. I mean in most cases there's not just a single programmer working on a single opensource project. Really weird. I hope they will make it clear before the proposal gets approved.

@debian I'm still concerned but the Python Software Foundation's post about the #EU's Cyber Resilience Act (#CRA) makes me optimistic that it could work for #FreeSoftware. I do agree with the core idea that #commercial #software companies should be held more accountable than they currently are. The key is getting it just right so that anyone can write whatever free software they feel like writing, and share it on the internet, without having to get a lawyer first.
