EXPLANATORY MEMORANDUM

1. CONTEXT OF THE PROPOSAL Freedom of thought, conscience, and religion constitutes a fundamental right enshrined in Article 10 of the Charter of Fundamental Rights of the European Union and Article 9 of the European Convention on Human Rights. The right to freedom of religion also implies the freedom to not adhere to any religion or to select elements of belief systems in a manner aligned with individual conscience. In the context of the Single Market, where the free movement of goods, services, capital, and persons fosters consumer choice and competition, the principles of freedom of choice and personal autonomy must be safeguarded not only in economic transactions but also in the broader cultural and spiritual domains. However, prevailing religious frameworks often tie the selection of deities to rigid institutional doctrines, limiting the capacity of individuals to construct personalised systems of belief.

This proposal aims to establish a harmonised framework for the decoupling of deity selection from religious affiliation across the EU, ensuring that individuals are free to select, combine, or disregard deities from one or multiple traditions without institutional constraint, in accordance with the values of pluralism, inclusivity, and non-discrimination.

2. LEGAL BASIS

This Directive is based on Article 114 of the TFEU, which provides for the approximation of laws for the proper functioning of the internal market, in conjunction with Articles 10 and 17 TFEU, which mandate respect for freedom of thought, conscience, and religion.

3. OBJECTIVES

- To ensure that individuals within the Single Market may select one or more deities independently of the institutional frameworks of organised religions.

- To prevent monopolistic or vertically integrated religious practices that condition the worship of specific deities on adherence to accompanying doctrines.

- To promote a competitive, interoperable spiritual landscape that fosters individual creativity and cross-tradition deity selection.

- To guarantee that all individuals, including those who self-identify as polytheistic, monotheistic, atheistic, syncretic, or agnostic, benefit from equal protection under EU non-discrimination law.

4. KEY PROVISIONS

. Article 1 — Subject Matter

This Directive establishes common rules ensuring that the selection of deities, divinities, or metaphysical entities within the EU is independent of religious institutions or doctrines.

. Article 2 — Definitions

For the purposes of this Directive:

- Deity means any supernatural or metaphysical entity traditionally associated with religious, spiritual, or philosophical systems, including but not limited to gods, goddesses, higher powers, animistic forces, or cosmic principles.
